TOWNSHIP ZONING BOARD OF APPEALS
MINUTES
OF MEETING HELD SEPTEMBER 5, 2006
A
meeting of the Brady Township Zoning Board of Appeals was held on September 5,
2006 commencing at approximately 6:30 p.m.
Members
Present: Chairman James Dyke
Vice-Chairperson Aileen Greanya
Ed Haberle
Kevin Allgaier
Mike Oswalt
Absent
was Jim Laure.
Also
attending were Zoning Administrator Glenn Lindsey and 5 concerned citizens.
Chairperson
James Dyke opened the Public Hearing.
Barbara
Hann, 11293 Schoolhouse Road in Brady Township, is requesting a variance of 5
feet from the right side yard setback in order to build an addition of a 3rd
stall onto an existing garage.
Chairman
James Dyke explained that the Zoning Board of Appeals must determine that a
hardship exists that prevents Mrs. Hann from meeting the 15 side yard
setback. Mrs. Hann stated that her
property has wetlands in the back, so that her house (with attached garage) was
built to the front and to the right side of her property.
Aileen
Greanya noted that the additional stall would not be blocking the view and that
most other properties in the neighborhood have 3 garage stalls.
The
Zoning Board of Appeals considered the variance request with the variance
standards as published in Article XXIII, Section 23.8 of the Brady Township
Zoning Ordinances. The members of the
ZBA agreed that all four conditions have been met.
There was no public comment. No written
communication has been received on this variance request.
Aileen
Greanya made a motion to approve the
variance request to allow the 5 side yard setback. Jim Dyke seconded the
motion, and it was passed
unanimously.
Lloyd
Sutton and Terri Weese, 7541 S. Indian Lake Drive, in Brady Township, have
requested a variance for relief from the side and rear yard setbacks in order
to replace an accessory building with a larger accessory building. The existing accessory building is a legal,
non-conforming structure.
Mr. Sutton stated that the current 10 x 12
accessory building is deteriorating and needs to be replaced. It is sitting on sand, with no concrete
footings. He wishes to replace it with
a 14 x 18 structure that is up to code.
Mr.
Sutton stated that the house is built very close to the road, and on one side
of the lot. He stated that on the 60
wide lot, there is really only one spot for the shed to be built. (The accessory building cannot be built in
the lakeside front yard.)
The
proposed left side yard setback is 6 (instead of the required 10) and the
rear yard set back is 3, but 28 from the road pavement.
The
Zoning Board of Appeals considered the variance request with the variance
standards as published in Article XXIII, Section 23.8 of the Brady Township
Zoning Ordinances. The members of the
ZBA agreed that all four conditions have been met.
There
was no public comment. No written communication has been received on this
variance request.
Kevin
Allgaier made a motion to approve
the variance requests based on compliance with Section 23.8 of the Brady
Township Zoning Ordinances. Jim Dyke seconded the motion, and it was passed unanimously.
There
was a motion by Aileen Greanya to
adjourn the meeting at 6:55 p.m., supported
by Kevin Allgaier and passed
unanimously.
