SPECIAL BOARD MEETING

March 17, 2009

Members Present: Supervisor Philport, Treasurer Allgaier, Clerk Vermeulen and Trustee Vander Kamp. Absent Trustee Guthrie*

Others Present: 4 others.

The meeting was called to order at 7:35 p.m. by Supervisor Philport at the Brady Township Hall. The purpose of the meeting was hold a Public Hearing to set an Industrial Development District for Steward Sutherland.

**A motion was made by Vermeulen and seconded by VanderKamp to approve the minutes of the 3/03/09 Regular meeting. Motion carried.

Philport opened the Public Hearing at 7:40 p.m. He explained the Industrial Development District. Anne Ligget, from Stewart Sutherland updated on the proposed need for the district for a piece of equipment. Brandon Lipes spoke in favor of the district. Philport closed the public hearing at 7:15.

**A motion was made by Vermeulen and seconded by VanderKamp to adopt this Resolution Establishing 2009 Stewart Sutherland, Inc Industrial Development District. A roll call vote brought YES votes from Allgaier, Philport, Vermeulen, and VanderKamp. Absent: Guthrie. Motion Carried and Resolution adopted.

**A motion was made by Vermeulen and seconded by VanderKamp to amend the current budget as follows:

                       From: Zoning Building Permits          $7500

                       To: Township Hall Electric                  600

                                 Office Clerical                           1600

                                  Pensions                                  3800

                                  Twp Board Legal Fees            1500 

A roll call vote brought YES votes from Philport, Vermeulen, VanderKamp, and Allgaier. Absent: Guthrie. Motion carried.

* At 7:52 p.m. Trustee Guthrie arrived at the meeting.

**A motion was made by Vermeulen and seconded by VanderKamp to adopt the proposed budget for 2009-2010. A roll call vote brought Yes votes from VanderKamp, Allgaier, Philport, Vermeulen, and Guthrie. Motion carried.

**A motion was made by Guthrie and seconded by Philport to go into closed executive session at 7:55 p.m. to discuss current litigation with Bryan Visser, 8^th District Court Case #080056A ON, and Linda Visser, HUD Case #05-08-1854-8; Inquiry #261747. A roll call vote brought YES votes from Allgaier, Philport, Vermeulen, Guthrie, and VanderKamp. Motion carried.

The Board returned to open regular session at 8:45 p.m.

**A motion was made by Vermeulen and seconded by Allgaier to adjourn the meeting at 8:55 p.m. Motion Carried.
